Reformasi Hukum Pidana Islam Kontemporer (Studi atas Pemikiran Abdullah Ahmed an-Naim)

Abstract

The application of Islamic criminal law (fiqh al-jinayah) into the system of government of a nation-state is a desire that continues to be fought for by some Muslims. Applications are usually marked by the implementation of hudud problems, such as cutting hands, whips, qisas, etc. which are intended to show how the “Islamic” regime is in power.
An-Naim wanted to show that the reality of the application of shari’a law by the state, as happened in Sudan during the administration of President Numeiri, was more political in nature. To be able to lead to applicable and contemporary Islamic criminal law to be applied must be in accordance with constitutional and International standards by taking into account two things, namely first, the principle of legality without discrimination, and second, the problem of punishment and treatment against prisoners.
